This was instituted on March 4, 1920, in the Court of First Instance of the City of Manila by the La Insular, an incorporated tobacco and cigar factory of Manila, to enjoin the defendant, B.E. Jao Oge, proprietor of the cigarette factory known as La Ciudad, in the same city, from using two labels as wrappers for his cigarettes. The defendant demurred to the complaint and the demurrer was sustained, whereupon the plaintiff elected to stand upon its complaint and a judgment of dismissal was entered.
