Before this Court is a Petition for Certiorari under Rule 65[1] of the Rules of Court filed by petitioner Office of the Ombudsman (OMB) seeking to set aside the Decision[2] of the Court of Appeals dated 31 May 2005 and Resolution[3] dated 30 May 2006 in CA-G.R. No. 79242. In the assailed Decision, the Court of Appeals declared that the OMB has no power to impose the penalty of dismissal from service of a public officer or employee, and its power is limited only to the recommendation of the said penalty if the public officer or employee concerned is found to be at fault.
