For review is the Decision[1] dated 13 December 2006 of the Court of Appeals in CA-G.R. CR-H.C. No. 02253 which affirmed with modification the Decision[2] dated 26 January 2001 of the Regional Trial Court (RTC) of Malolos, Bulacan, Branch 21, in Criminal Case No. 599-M-2000, finding herein appellant Wenceslao Espino, Jr. y Saura, alias "Joe Pring" guilty beyond reasonable doubt of the crime of simple rape committed against AAA.[3]
