The instant petition for certiorari and prohibition seeks to set aside the Resolution[1] of the Commission on Elections (COMELEC) En Banc dated September 25, 2008 in SPC Case No. 07-201, denying private respondent Dante Manganaan's petition to nullify Statements of Votes by Precinct (SOVP) Nos. 0000877, 0000878, 0000879 and 0000880, and instead treated the same as a petition to correct manifest errors found in said SOVPs.
