This is an appeal from the Decision[1] dated August 15, 2005 of the Court of Appeals (CA) in CA-G.R. CR-H.C. No. 00223, affirming the Decision[2] dated January 7, 2004 of the Regional Trial Court (RTC) of Calauag, Branch 63, in Criminal Case No. 3024-C, finding appellant Elegio An guilty beyond reasonable doubt of the crime of simple rape.
