For review is the Decision[1] of the Court of Appeals dated August 1, 2006, which affirmed with modification the Decision[2] rendered by the Regional Trial Court (RTC), Branch 41, Pinamalayan, Oriental Mindoro, in Criminal Case No. P-5558, finding accused-appellant Teddy Magayon (Magayon) guilty beyond reasonable doubt of the crime of Rape as defined and penalized under Article 335, paragraph 3, of the Revised Penal Code, imposing the penalty of reclusion perpetua, and ordering Magayon to pay the offended party Fifty Thousand Pesos (P50,000.00) as moral damages.
