Before this Court on appeal is the Decision[1] dated 2 February 2007 of the Court of Appeals in CA-G.R. CR. No. 00215 affirming with modification the Decision[2] dated 4 November 2003 of the Regional Trial Court (RTC) of Tarlac City, Branch 64 in Criminal Case No. 12536. The RTC found the accused Romeo Labagala, Alvin Labagala and Richard Allan Alejo guilty beyond reasonable doubt of the special complex crime of robbery with homicide. The Court of Appeals modified the RTC's decision by acquitting the accused Richard Allan Alejo.
