On March 3, 1943, Felipe de Santos filed a complaint to eject Basilio de Castro from the premises at No. 1045 M. de Santos, Manila, and for the collection of rentals at the rate of P140 monthly beginning February, 1943. After trial, the Municipal Court of Manila dismissed the complaint. Santos appealed.
