WILLARD, J.:

The plaintiffs brought this action in the court below to enjoin the defendant from interfering with two gold mines alleged to be the property of the plaintiffs. A temporary injunction was granted as prayed for in the complaint; the case was tried in the court below and the injunction made perpetual. The defendant moved for a new a trial, which was denied, and he has brought the case here by bill of exceptions. the court below found, among other things, substantially as follows:
