"The principle that a person cannot be prejudiced by a ruling rendered in an action or proceeding in which he was not made a pa1iy conforms to the constitutional guarantee of clue process of law."[1]

This Petition for Review on Certiorari[2] assails the October 25, 2007 Decision[3] or the Court of Appeals (CA) in CA-G.R. CV No. 83027 which set aside the December 8, 2003 Order[4] of the Regional Trial Court, Makati City, Branch 61, in Civil Case No. 01-572, as well as the CA Resolution on[5] dated March 12, 2008 denying petitioners' Motion for Reconsideration.[6]
