The most important questions raised by the appeals in this case have to do with the power of the surviving husband, after the death of his wife, to sell or mortgage the community property acquired during coverture. In the course of these proceeding, as also in the course of the proceedings had in the case of Anson vs. Carrascoso and Roman Catholic Church of Nueva Caceres (R.G., No. 9048), 1 the power of the surviving husband in this regard is hotly contested, and the validity of such sales and mortgages is drawn in question by the heirs of the deceased wife....
