The Case

Before the Court is a Petition for Review on Certiorari filed under Rule 45 challenging the Decision 1 and Resolution2 of the Court of Appeals (CA) in CA-G.R. CV No. 98919 dated July 8, 2013 and November 22, 2013, respectively. The challenged rulings affirmed the May 7, 2012 Decision3 of the Regional Trial Court (RTC), Branch 68 in Camiling, Tarlac that petitioners and respondents are co-owners of the subject property, which should be partitioned as per the subdivision plan submitted by respondent spouses Recto and Rosemarie Candelario.
