Before the Court is an appeal assailing the Decision[1] dated February 29, 2012 of the Court of Appeals (CA) in CA-G.R. CR-HC No. 03409 finding accused-appellants Marcelino Viterbo y Realubit (Marcelino) and Ronald Viterbo y Realubit (Ronald) guilty beyond reasonable doubt of the crime of violation of Section 5, Article II of Republic Act No. (RA) 9165,[2] otherwise known as the “Comprehensive Dangerous Drugs Act of 2002.”
