At the outset, it should be made very clear that this petition for certiorari and mandamus with application for a temporary restraining order should be decided in disregard of the personalities involved and stripped of the perceived politics that surround it. There is one primordial matter that should concern the Court in this instance and that is the concept of procedural fairness dictated by the due process requirement mandated by the Constitution, as viewed within the context of the special nature and functions of the Judicial and Bar Council (JBC).
