Prefatory Statement
 
I write this Separate Concurring Opinion to express my CONCURRENCE with the ponencia of my esteemed colleague - Justice Jose Catral Mendoza - and to reflect my own views on this case of first impression.

This case is the first test, since the establishment in 1987 of the Judicial and Bar Council (the JBC), of its even-handedness and the extent of the discretion granted to it in determining the shortlist of nominees for a vi;icant position in the judiciary.
