This is an appeal from the Decision of the Court of Appeals1 in CA G.R. CEB CR-HC No. 00558, which affirmed the Decision2 dated 17 September 2004 of the Regional Trial Court, Branch 13, Carigara, Leyte (RTC), finding the accused-appellant Sander Dacuma (Dacuma) guilty of illegal sale of shabu or methamphetamine hydrochloride, a dangerous drug, in violation of Sec. 5 of Republic Act No. 9165, otherwise known as The Comprehensive Dangerous Drugs Act of 2002.
