Whoever acts as Notary Public must ensure that the parties executing the document be present.  Otherwise, their participation with respect to the document cannot be acknowledged.  Notarization of a document in the absence of the parties is a breach of duty.
 
Complainants Jimmy Anudon (Jimmy) and Juanita Anudon (Juanita) are brother- and sister-in-law.[1]  Complainants and Jimmy’s brothers and sister co-own a 4,446-square-meter parcel of land located in Sison, Pangasinan covered by Transfer Certificate of Title (TCT) No. 69244.[2]
