LEONEN, J.:
 
I regret that I cannot bring myself to agree that the warrantless arrest was valid.
 
To review, the facts as established are as follows:
 
Both petitioners and respondent are residents of Kasiyahan Street, Barangay Holy Spirit, Quezon City.[1]
 
On February 20, 2005, at around 3:00 to 3:15 a.m., petitioners Joey M. Pestilos (Pestilos), Dwight Macapanas (Macapanas), Miguel Gaces (Gaces), Jerry Hernandez (Hernandez), and Ronald Muñoz (Muñoz), and respondent Atty. Moreno Generoso (Atty. Generoso) were waiting for the water supply on Kasiyahan Street. Pestilos and...
