Habeas corpus is the proper remedy for a person deprived of liberty due to mistaken identity. In such cases, the person is not under any lawful process and is continuously being illegally detained.
 
This is a Petition for Review[1] on Certiorari of the Court of Appeals Decision[2] reversing the Decision[3] of the Regional Trial Court, Branch 153, Pasig City (Taguig Hall of Justice) granting Datukan Malang Salibo's Petition for Habeas Corpus.
 
From November 7, 2009 to December 19, 2009, Datukan Malang Salibo (Salibo) and other Filipinos were allegedly in Saudi Arabia for the Hajj Pilgrimage.[4]...
