This is a petition for review on certiorari[1] filed under Rule 45 of the Rules of Court, assailing the Resolution[2] dated January 14, 2009 of the Court of Appeals (CA) in CA-G.R. CEB CV No. 01380, which dismissed the appeal on the ground of non-payment of appeal fees.
