As this is the second appeal of this case, a brief review of the proceedings leading up to the first appeal and the decision thereof will be pertinent.

On March 26, 1930, an information was filed in the Court of First Instance of the City of Manila, charging that Antonio Ubaldo, Felix Tuazon, Agapito Toreno, Elpidio Gaspay and Remedios Avelino de Linao conspired together to murder Joaquin Linao, the husband of Remedios Avelino, and feloniously assaulted and wounded him about midnight on the 24th day of March 1930.
