Assailed in this petition for review on certiorari[1] are the Decision[2] dated March 19, 2009 and the Resolution[3] dated September 3, 2009 of the Court of Appeals (CA) in CA-G.R. CV No. 86266, which set aside the Order[4] dated October 10, 2005 of the Regional Trial Court of Baguio City, Branch 61 (RTC Br. 61), and consequently, remanded the case to the latter court for trial.
