The commission of rape offends social fabric. It is an affront to human dignity and if tolerated or dealt with leniency, even encourages criminality. No court of law should take an accusation of rape lightly; at the same time, however, it has the duty to protect the Constitutional right of the accused to be presumed innocent unless proven otherwise. When a woman cries rape, the Court is bound to balance the natural inclination to commiserate with the victim, with logic and legal precepts.
