I concur only insofar as the petitions are dismissed — but with a call that the allocation of party-list seats laid down in Barangay Association for National Advancement and Transparency (BANAT) v. Commission on Elections,[1] (BANAT) should be abandoned as it is inconsistent with, and fails to reflect, the spirit and intent of the Constitution and Republic Act No. (RA) 7941 or the Party-List System Act.[2]
