PADILLA, J., concurring: 

Although I maintain that we have jurisdiction as petitioners contend, I can't vote for them, because the enrolled copy of the resolution and the legislative journals are conclusive upon us. 

A. The overwhelming majority of the state courts are of the opinion that the question whether an amendment to the existing constitution has been duly proposed in the in the required by such constitution properly belongs to the judiciary. That is the position taken by Alabama, Arkansas California, Colorado, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Louisiana, Maryland, Massachusetts,...
