PERFECTO, J:

The information filed against appellant accused him of treason on seven counts. At the trial, the prosecution offered evidence to prove only three counts, Nos. 1, 3, and 7, which are reproduced as follows:

"1. That during the Japanese occupation, in the City of Cebu, Philippines, and within the jurisdiction of this Court, the accused herein, with intent to adhere and give aid and comfort to the enemy above mentioned, did then and there wilfully, illegally, feloniously and treasonably accept the position of, and act as an undercover agent and/or spy for the Japanese Military Police, otherwise known as Kempei...
