Five Chinese citizens detained by our immigration authorities for purposes of deportation have instituted this proceeding to test the legality of their confinement and proposed expulsion from the Philippines. The use of habeas corpus to accomplish that objective is now a settled practice.[1]

It appears that, having received information that Tan Eng Tian, Pia Uy, Vicente Uy, Lu Bon King alias Lee and Ong Chi Ben, all Chinese nationals residing in this country, were communists actively engaged in communistic work and were disseminating red propaganda in addition to trafficking in firearms destined for...
