The present case here on appeal has its origin in Special Proceedings No. 12126 in the Court of First Instance of Manila, initiated by Roman Ozaeta, for the probate of the will said to have been left by Carlos Palanca Tanguinlay who died on September 2, 1950, in the City of Manila. The due execution and probate of said will was decided by the trial court which decision is now on appeal.
