This is an appeal, taken by the prosecution, from a decision of the Court of First Instance of Manila, the dispositive part of which reads as follows:

"Wherefore, defendant Luis M. Taruc is hereby declared guilty, by his own confession in open court, of the crime of rebellion, charged in the information herein, as lastly amended, defined and punished under Articles 134 and 135 of the Revised Penal Code, and in accordance with paragraphs 4 and 6 of Article 64 of the same Code, he is sentenced to suffer the penalty of twelve (12) years of prision mayor, together with the accessory penalties provided for by...
