This is an appeal taken by the Commissioner of Immigration from the decision of the Court of First Instance of Albay in its Civil Case No. 2567.

On June 22, 1958 Felisa Lee, a Chinese citizen, married Jackson Barra, a Filipino citizen. Claiming to have acquired the citizenship of her husband by virtue of her marriage on the ground that she possessed all the qualifications and none of the disqualifications for naturalization as a Filipino citizen, she applied to the Commissioner of Immigration for cancellation of her Alien Certificate of Registration.
