In this appeal from a lower court decision sentencing the accused 1 to reclusion perpetua, arising from a prosecution for murder, the antecedent circumstances that led to the killing of the hapless victim Diogenes Esquilona are by no means unique, considering the state of Philippine society in the rural areas. A group gathered together in what should be a convivial atmosphere, imbibing tuba, can end up in dissension, with a harsh exchange of words, the boundaries of rhetoric being crossed and exploding into physical violence and even death.
