On the 29th of October, 1884, Manuel Ramirez, defendant and appellant, and Chuidian Buenaventura & Co., a mercantile association of which plaintiff and appellee is liquidator, and which will hereinafter be referred to as the plaintiff company, jointly executed a notarial instrument, which was duly recorded in the mortgage registry of the city of Manila, wherein Ramirez solemnly acknowledged himself to be indebted to the plaintiff company in the sum of 10,000 pesos, local currency, received by him from the plaintiff company "en calidad de prestamo mutuo" (by way of, or in virtue of the class of loans defined...
