What is sought to be set aside in this certiorari proceeding by the Secretary of Finance is a mandatory preliminary injunction issued by respondent Judge Enrique Agana of the Court of First Instance of Rizal, ordering him as well as the other petitioners, Tariff Commissioner Razon P. Haresco and Collector of Customs Augusto T. Africa, to immediately release the importation of private respondent 1 of 10,760 feet of steel pipes or casings without paying the anti-pumping duties as ordered by the aforesaid Secretary in Dumping Case No. 70-3.
