In this connection, We hasten to add that We are not overlooking the guidelines for the voluntary inhibition of judges laid down in Pimentel vs. Salanga, 21 SCRA 160, quoted by counsel for Protestee. As a matter of fact, We reiterate what We said there: "To disqualify or not to disqualify is a matter of conscience" and is addressed primarily to the sense of fairness and justice of the judge concerned. We have to be shown acts or conduct of the judge clearly indicative of arbitrariness or prejudice before We can brand him with the stigma of being biased or partial and of violating his sworn duty to "administer justice without...
