The main opinion holds that it "is plain and evident from Sections 3 and 6 of their organic act, Republic Act 5179" that circuit criminal courts "have the same powers and functions as those conferred upon regular Courts of First Instance necessary to effectively exercise (their) special and limited jurisdiction." But I am afraid this reasoning ignores that "the powers and functions (of) the regular Courts of First Instance" conferred upon the circuit criminal courts are only those "necessary (for them) to effectively exercise (their) special and limited jurisdiction", and the issue precisely is what is the extent of that...
