D E C I S I O N

FERNANDO, J:

As has happened ever so often in rape cases, while the fact of sexual intercourse is not denied, the defense raised is that there was consent on the part of complainant. So it is in this appeal by the accused Reynaldo Godoy y Monteverde, sentenced to reclusion perpetua after his guilt was adjudged. Nor would his counsel have this Court rely on his word alone. They did carefully analyze the evidence offered by the prosecution to demonstrate that the constitutional presumption of innocence was not overcome.1
