TRENT, J.:

This action was instituted in the Court of First Instance of the Province of Occidental Negros to recover from the defendant the sum of P2,261 Philippine currency, Judgment was rendered in favor of the plaintiffs for this amount. The defendant appealed and now insists:

1. That this action was prematurely brought; and,

2. That Exhibit A, the document which forms the basis of this action, is null and void for the reason that the internal-revenue stamps are not affixed thereto, as required by section 58 of Act No. 1189.
