ABAD SANTOS, J:

This is an appeal interposed on December 6, 1968, by the accused Pedro Duarte from the decision of the Court of First Instance of Samar, 13th Judicial District, Laoang, Samar, sentencing him to suffer the penalty of reclusion perpetua, to indemnify the heirs of the victim in the amount of P6,000.00 and to pay 1/4 of the cost. In view of the imposition of the death penalty with respect to the accused Tito Nale, Duarte's case is simultaneously on review by this Court.
