This is an appeal from the decision, August 31, 1972, of the Circuit Criminal Court of Cebu City in Criminal Case No. CCC-XIV-613-Cebu, convicting SHEM JAKOSALEM of the crime of Robbery with Homicide and sentencing him to suffer the penalty of RECLUSION PERPETUA, the dispositive portion of which reads as follows:
