In essence, this petition for mandamus and prohibition is not dissimilar from the prohibition proceedings just dismissed filed respectively by former delegates Samuel C. Occeña and Ramon A. Gonzales. [1] All three suits proceed on the assumption that the present Constitution is not in force and effect. There is this variation. In the last two paragraphs of this petition, the plea is made for the holding of a plebiscite so that the people may vote on the ratification of the Constitution, now in force, but as to them still in the stage of proposal.
