The invocation of the constitutional right to freedom of expression 1 in a motion to dismiss an action for damages filed by petitioners as defendants failed to obtain an affirmative response from respondent Judge Amante P. Purisima. Hence, this certiorari, prohibition and mandamus proceeding, assailing on jurisdictional grounds the order denying such motion.
