MELENCIO-HERRERA, J., concurring:

The facts of this case, which I believe to be relevant, may be briefly stated thus:

1. Raymundo C. Bañas (the Child, for brevity) was born on March 15, 1894, the son of Dolores Castillo, single.

2. On May 23, 1907, when the Child was thirteen (13) years old, Dr. Bibiano Bañas, a surgeon (hereinafter called Decedent), allegedly sent him a handwritten letter (the Note, for short) as follows:

"Mundo, hoy a las 10 y 45. Tu no estas en casa no quieres tu obedecer lo que te dije, que en estas horas estudiar, descansar y ayudar con su madre. Que no veo mas otravez asi.
