Juan Rosario and his two sons, Santiago and Salvador both surnamed, Rosario were charged with the crime of murder in an information filed with the Court of First Instance of Pangasinan.

On arraignment, the accused pleaded not guilty. After a protracted trial, the Court rendered its decisions acquitting Juan Rosario of the crime of homicide. His sons, Santiago Rosario and Salvador Rosario were found guilty of the crime of homicide with abuse of superior strength as an aggravating circumstance.
