The sole issue to be resolved in this case is the legality of Administrative Order No. 3, issued on January 10, 1972, by the then mayor Marcial F. Samson, of Caloocan City, one of the petitioners herein, whereby petitioner mayor summarily terminated the services of the private respondent, Feliciano C. Talens, who held the position of Assistant Secretary to the Mayor, on the ground of "lack and loss of confidence" and appointing in place of the latter Hermogenes Liwag, a co-petitioner in this case.
