Petitioner Ramon Borguilla and one Hernando Caray were charged with the crime of murder before the Circuit Criminal Court of Rizal, Branch VII. After trial, the court a quo acquitted Hernando Caray for insufficiency of evidence, while petitioner was found guilty beyond reasonable doubt of murder under Article 248 of the Revised Penal Code.
