Defendant-appellant Leopoldo Traya alias "Dady" was one of four persons accused before the Circuit Criminal Court of Tacloban City 1 of the killing of Dr. Pedro Alvero in Abuyog, Leyte on November 19, 1967. The others were Octavio Traya, Leopoldo's father, who was acquitted after trial on the ground of reasonable doubt, Wenceslao Verterra alias "Winnie," who was convicted of homicide and sentenced to reclusion temporal in its maximum period, and Antonio Natulla alias "Titoy," who was never apprehended and remained at large throughout the trial.
