I hail the Court's unanimous judgment 1 vacating and setting aside the penalty of death by electrocution summarily imposed by respondent military commission on December 4, 1984 upon the principal petitioners Eduardo Olaguer, Othoniel Jimenez, Reynaldo Maclang and Ester Misa Jimenez for lack of jurisdiction of military commissions over civilians, and expressly overturning and rejecting the contrary 1975 ruling in Benigno S.
