NARVASA, J.:

Subject of this appeal are a promissory note and a real estate mortgage securing its payment, each appearing on its face to have been executed on behalf of the respondent corporation by its president. The question presented is whether, upon the evidence offered and received concerning the circumstances surrounding their execution, they are binding on said respondent. Both the Trial Court and the Intermediate Appellate Court ruled that they are not, to which rulings the mortgagee takes exception in the petition now before the Court.
