Romeo Caringal appeals from the Decision of Branch 89 of the Regional Trial Court of Quezon City in Criminal Case No. Q-26832, convicting him of the crime of murder.

Approximately half-an-hour past midnight in the early morning of 4 January 1983, Francisco Eugenio was assaulted and stabbed while he was asleep inside a market stall, owned by one "Aling" Liwayway, in the Galas public market in Quezon City.
