The petition filed in this action is as follows:

"Comes now the undersigned Insular Collector of Customs, and under authority of section 313 of the Customs Administrative Act, as amended by section 5 of Act No. 864, Act No. 1405, and section 1 of Act No. 1576 of the Philippine Commission, brings to the attention of the court the following, to wit:
